A bail bondsman will charge a non-refundable fee of 10% of the bail amount (Godfather’s charges 9% if the bail amount is more than $5,000) and 15% for federal cases.  Most bondsmen offer several payment options including debit cards, credit cards, and installment plans.  They’ll work with you to figure out what fits your budget.

You should still call a bondsman and have him explain your options.  There are several reasons that you should consider using a bondsman even if you have the cash.

  • Tying up all your cash may make it difficult to pay your bills while you’re waiting for trial.
  • You may be denied a court-appointed lawyer if the court knows you have cash.
  • The court will take the cash to pay any fines or court fees.
Call your bondsman immediately.  There may still be opportunities to rectify the situation before your property is forfeited.

If the defendant fails to appear, an arrest warrant is issued for him and the bondsman or a recovery agent will track him down and return him to jail and bail is revoked.  Costs
associated with his recovery may be passed onto the defendant.  Any collateral will be sold to pay for the bail.

A cosigner, also called the Indemnitor, is the person that puts ups collateral on behalf of the defendant.  It is the cosigner’s property that is at risk if the defendant flees.

The defendant or a friend or family member may offer collateral.  It is important to consider offering collateral very carefully.  If the defendant “skips” or doesn’t show up for trial, any collateral will be forfeited so it is your responsibility to make sure the defendant makes his appearances.
